Common Law Tradition


Court of Common Pleas - In United States jurisprudence, Court of Common Pleas is a term referring to a court of certain jurisdiction. It stems from the Court of Common Pleas in the English legal system and was brought to the United States by the colonial settlers along with the rest of the English common law tradition.

Non-statutory law - Non-statutory law is the basis of the common law system. Its authority rests not on legislation passed by Parliament and/or Administration and eventually codified, but rather tradition, custom, and especially precedent.

Legitimacy (law) - In the common law tradition, legitimacy describes the status of children who are born to parents that are legally married. Its opposite is bastardy, the status of being a bastard, a person born to unmarried parents, or to a married woman but whose father was someone other than her husband.

Civil law (common law) - In the common law, civil law refers to the area of law governing relations between private individuals. It also is used to describe all law outside of the criminal law context.

Written with a vigor common law tradition and passion rarely found in a scholarly text, this broad history of the western European legal tradition is now available in an elegant common law tradition and lucid translation from the original Italian. Here Manlio Bellomo looks back to a time when Europe had a common law that transcended national common law tradition and legal boundaries. This common law, which the author calls the ius commune, developed in the twelfth century from the fusion of Roman, canon, common law tradition and feudal law, common law tradition and held sway for centuries until several factors ultimately conspired to undermine its influence. Linking his extensive history to modern-day concerns, Bellomo argues that the codification that occurred in European countries during the eighteenth common law tradition and nineteenth centuries has introduced ambiguity, rigidity, common law tradition and uncertainty into legal systems.
