Common Law Civil Law


Civil law (common law) - In the common law, civil law refers to the area of law governing relations between private individuals. It also is used to describe all law outside of the criminal law context.

Law of the United Kingdom - The law of the United Kingdom consists of several independent legal systems which use common law principles, civil law principles, or both. England and Wales as well as Northern Ireland use the common law system, while Scotland uses a hybrid system which combines elements from the common law and the civil law system.

Comparative law - Comparative law has increased enormously in importance in the present age of internationalism, economic globalisation and democratisation. It is the study of differences and similarities between the law of different countries and, more generally, of the different legal families, the common law family, the civil law family, the socialist law, the islamic law family and the Asian law family.

Scots law - Scots law (or Scottish law) is the law of Scotland. It is a unique system with ancient roots and has a basis in Roman law, combining features of both uncodified Civil law dating back to the Corpus Juris Civilis and common law with medieval sources.

Mixed Legal Systems in Comparative Perspective: Property and Obligations in Scotland and South Africa
Placed uniquely at the intersection of common law common law civil law and civil law, mixed legal systems are today attracting the attention both of scholars of comparative law, common law civil law and of those concerned with the development of a European private law. Pre-eminent among the mixed legal systems are those of Scotland common law civil law and South Africa. In South Africa the Roman-Dutch law, brought to the Cape by the Dutch East India Company in 1652 was, from the early nineteenth century onwards, infused with common law civil law and re-moulded by the common law of the British imperial master. In Scotland a more gradual common law civil law and elusive process saw the Roman-Scots law of the early modern period fall under the influence of English law after the Act of Union in 1707. The result, in each case, was a system of law which drew from both of the great European traditions whilst containing distinctive elements of its own. This volume sets out to compare the effects of this historical development by assessing whether shared experience has led to shared law. Key topics from the law of property common law civil law and obligations are examined, collaboratively common law civil law and comparatively, by teams of leading experts from both jurisdictions.
