Civil law (common law) - In the common law, civil law refers to the area of law governing relations between private individuals. It also is used to describe all law outside of the criminal law context.

Federal common law - Federal common law is a term used in the United States to describe common law that is developed by the federal courts, instead of by the courts of the various states. Although the United States Supreme Court has effectively barred the creation of federal common law in areas traditionally under the authority of state courts, there are several areas where federal common law continues to govern.

Common-law marriage - Common-law marriage (or common law marriage), sometimes called informal marriage or marriage by habit and repute is, historically, a form of interpersonal status in which a man and a woman are legally married. The essential elements of a common law marriage are that a man and woman, both of whom are of legal age to contract a statutory marriage, mutually consent to live together and hold themselves out to the world as husband and wife.

Common law - The common law forms a major part of the law of many countries, especially those with a history as British territories or colonies. It is notable for its inclusion of extensive non-statutory law reflecting precedent derived from centuries of judgments by judges hearing real cases.

The Common Legal Past of Europe: 1000-1800 by Manlio Bellomo,

Written with a vigor common law and passion rarely found in a scholarly text, this broad history of the western European legal tradition is now available in an elegant common law and lucid translation from the original Italian. Here Manlio Bellomo looks back to a time when Europe had a common law that transcended national common law and legal boundaries. This common law, which the author calls the ius commune, developed in the twelfth century from the fusion of Roman, canon, common law and feudal law, common law and held sway for centuries until several factors ultimately conspired to undermine its influence. Linking his extensive history to modern-day concerns, Bellomo argues that the codification that occurred in European countries during the eighteenth common law and nineteenth centuries has introduced ambiguity, rigidity, common law and uncertainty into legal systems. A new common law for Europe, he asserts, would provide a much better vehicle for legal change common law and development in a time when the economic barriers between European nations are crumbling. Having set the stage for a historical treatment of the topic, Bellomo then describes the beginnings of the ius commune in the schools of the twelfth century. He explains how the iura propria, or local laws, emerged from the unifying norms common law and principles of the ius commune. Bellomo uses carefully chosen examples to illustrate how for centuries the ius commune permeated every aspect of the iura propria, marking European law indelibly with its stamp. He discusses the great jurists who gave common law its intellectual vigor - Gratian, Accursius, Odofredus, Cinus, common law and Bartolus - common law and concludes with an account of the humanist jurists of the fifteenth, sixteenth, common law and early seventeenth centuries.

Awarded the Bancroft Prize in American History in 1978, Morton J. Horwitz's The Transformation of American Law, 1780-1860 is considered one of the most significant works ever published in American legal history. Since its publication in 1977, it has become the standard source on early nineteenth-century American law. In this monumental book, Morton J. Horwitz offers a sweeping overview of the emergence of our national (and modern) legal system from English common law and colonial antecedents. He begins with the common law, which emerged during the eighteenth century as the standard doctrine with which to solve disputes in an egalitarian manner. He shows that the turning point in the use of common law came after 1790, when the law was slowly transformed to favor economic growth common law and development, common law and the courts began to spur economic competition rather than circumscribe it. This new instrumental law would flourish during the nineteenth century as the legal profession common law and the mercantile elite forged a mutually beneficial alliance to gain wealth common law and power. Horwitz also demonstrates how the emergence of contract law corresponded to the development of economic common law and legal institutions of exchange. And he discusses how the rise of the market economy influenced legal practices, how contracts became ways to negate preexisting common law duties, common law and how (to the benefit of entrepreneurs common law and commercial groups) the courts were able to overthrow earlier anticommercial legal rules. Previous historical studies have viewed law common law and policy as an accurate reflection of the needs of an undifferentiated society. In The Transformation of American Law, Horwitz successfully challenges this misconception common law and shows how, in theeighty years after the American Revolution, a major change in law took place in which aspects of social struggle turned to legal channels for resolution.
